1. Acceptance of Terms
By accessing the Freedom Flooring & Design website (freedomflooringmi.com) or engaging our services, you agree to these Terms of Service. These terms apply to all visitors, customers, and others who access or use our services. If you do not agree with any part of these terms, please do not use our website or services.
"Freedom Flooring," "we," "us," and "our" refer to Freedom Flooring & Design, based in Grand Haven, Michigan. "You" refers to the customer or website visitor.
2. Scope of Services
Freedom Flooring & Design provides flooring installation, design consultation, floor and wall remodeling coordination, and related services to residential and commercial customers in West Michigan. The specific scope of work for any project will be defined in a written proposal or contract provided to you before work begins.
Services are subject to availability, geographic reach, and scheduling. We reserve the right to decline a project at our discretion.
3. Estimates and Quotes
Estimates are not binding contracts. Any written or verbal estimate, quote, or price range provided before a final proposal is signed represents our best assessment at the time and is subject to change based on actual site conditions, material availability, and scope adjustments discovered during the project.
A binding agreement is established only when both parties have signed a written proposal or service agreement. At that point, the agreed-upon price and scope are fixed unless modified in writing by mutual consent.
Conditions that may affect final pricing include: subfloor damage or unevenness discovered after removal of existing flooring, changes in material availability or pricing, and any scope additions requested by the customer during the project.
4. Deposit and Payment Terms
Most projects require a deposit to secure scheduling and order materials. Deposit amounts and payment schedules will be clearly stated in your written project agreement. Standard payment terms are as follows unless otherwise specified in your proposal:
- •Deposit: Required upon signing the project agreement to reserve your installation date and order materials
- •Progress payments: May apply for larger projects; terms specified in your agreement
- •Final payment: Due upon project completion and customer walkthrough
Late payments may be subject to a 1.5% monthly interest charge. We reserve the right to suspend or terminate services on accounts with overdue balances.
Cancellation of a confirmed project after materials have been ordered may result in forfeiture of the deposit to cover material restocking, ordering, and scheduling costs.
5. Warranty
Workmanship warranty: Freedom Flooring & Design warrants our installation workmanship against defects for one (1) year from the date of project completion. This covers issues directly attributable to installation quality — not normal wear, damage caused by the customer, or product defects.
Mohawk product warranty (pass-through): Mohawk flooring products carry manufacturer warranties including the Mohawk 40-Year Limited Residential Warranty on qualifying products. These warranties are passed through directly from Mohawk to you as the homeowner. Freedom Flooring serves as an authorized dealer and can assist in navigating warranty claims, but Mohawk's warranty terms and coverage are determined solely by Mohawk. Warranty exclusions: Warranties do not cover damage from flooding, subfloor movement, pet damage exceeding normal use, improper cleaning products, or customer modifications after installation.
6. Customer Responsibilities
To ensure a successful installation, customers are responsible for:
- ✓Clearing furniture from the installation area before the crew arrives (unless furniture moving is included in your agreement)
- ✓Ensuring the home is accessible and at a stable temperature (60–80°F) for acclimation of materials
- ✓Disclosing known subfloor issues, prior water damage, or other conditions that may affect the installation
- ✓Following post-installation care guidelines provided by our team
7. Limitation of Liability
To the maximum extent permitted by applicable law, Freedom Flooring & Design's total liability to you for any claim arising from our services or this agreement shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or damage to property not directly related to the flooring installation, even if we have been advised of the possibility of such damages.
This limitation does not apply to damages resulting from our gross negligence or willful misconduct.
8. Website Use
The content on freedomflooringmi.com — including text, images, and design — is the property of Freedom Flooring & Design and is protected by applicable copyright laws. You may not reproduce, distribute, or use our content without written permission. The website is provided "as is" without warranties of any kind. We reserve the right to modify, suspend, or discontinue any part of the site without notice.
9. Governing Law & Dispute Resolution
Governing law: These Terms of Service are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding relating to these terms or your use of our services shall be brought exclusively in the state or federal courts located in Ottawa County, Michigan.
Dispute resolution: Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve any dispute through direct communication. Contact us at info@freedomflooringmi.com. If informal resolution fails after 30 days, either party may pursue available legal remedies.
10. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes take effect upon posting to this page with an updated "Last updated" date. Continued use of our website or services after changes constitutes acceptance of the revised terms. For projects already under a signed agreement, the terms in effect at signing govern that project.
